Instructions for Purchasing and Sharing Ownership of a Gated Apartment Unit in Jamaica
Your interest in our exclusive gated apartment complex in Jamaica is appreciated. This document outlines the process, terms, and conditions for purchasing and sharing ownership of a unit within the complex.
1. Ownership Structure
Each apartment unit will be co-owned by two individuals. Both owners will receive equal share equity certificates in the owning entity. Each owner may designate a beneficiary who will inherit their share in the event of unforeseen circumstances.
2. Buying Into the Project
The purchase price per owner is USD $TBA.
Each owner must deposit their funds into the designated attorney’s escrow account.
The project is expected to be completed within 24 months from the commencement of construction.
3. Usage Agreement
Each owner is entitled to use the apartment for six months per year.
If an owner chooses not to use their full six-month allocation, they may rent out their time via Airbnb or other rental platforms, in accordance with complex policies.
Use outside of an owner's designated period is only permitted with mutual agreement.
When one owner is in residence, the other may not occupy the unit unless prior mutual agreement is communicated to management.
4. Guest Policy
No family members or guests are allowed to occupy the unit unless the owner is present.
If an owner wishes to allow guests during their absence, a formal agreement must be reached with the co-owner and submitted to management.
5. Selling or Transferring Ownership
Owners wishing to sell must first obtain agreement from the co-owner.
The selling party is responsible for any legal or administrative costs related to the transfer.
New co-owners must comply with all existing terms and conditions of the complex.
6. Financial and Legal Matters
All financial transactions must be processed through the attorney’s escrow account.
Both owners are required to sign a legal agreement outlining their rights and responsibilities.
Disputes must be resolved through mutual discussion or, if needed, legal mediation.
By participating in this investment, all parties acknowledge and agree to the terms outlined above. This structure ensures a fair, secure, and seamless co-ownership experience while preserving the integrity and smooth operation of the apartment complex.
